Terms and Conditions for GO! Site Ready

Welcome to GO! Site Ready! These Terms and Conditions (“Terms”) govern your access to and use of the GO! Site Ready software-as-a-service platform and associated services (collectively, the “Service”) provided by Project Is A Go Pty Ltd (“PIAGO”, “we”, “us”, or “our”), located at https://gositeready.com.
By accessing or using the Service, creating an account, or clicking to accept these Terms when this option is made available to you, you agree to be bound by these Terms and our Privacy Policy (which will be provided as a separate document). If you do not agree to these Terms, you must not access or use the Service.
If you are using the Service on behalf of an organisation or entity (“Organisation”), then you are agreeing to these Terms on behalf of that Organisation, and you represent and warrant that you have the authority to bind the Organisation to these Terms. In that case, “you” and “your” will refer to that Organisation.
1. The Service
GO! Site Ready is a 100% cloud-based workforce management platform designed for heavy industry. The Service aims to simplify the management of personnel and equipment, providing access to comprehensive records of personal information, roles, costs, skills, job associations, competencies, and secure document management. Key features include Training Needs Analysis, certification tracking, an Intelligent Job Scheduler, asset management with real-time insights, and integrated push notifications.
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that PIAGO will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service. We will make reasonable efforts to notify you of any significant changes.
2. User Accounts
We may collect Personal Data about you in a variety of ways. The information we may collect via the Service includes:
- Contact Data: Including your email address, telephone number, and billing/physical address.
- Account Responsibilities: You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with this security obligation.
- Account Security: We implement security measures to protect your account and data; however, you are responsible for configuring and using the Service in a secure manner
3. Acceptable Use
You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You specifically agree not to:
- Upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Use the Service to store or transmit infringing, libelous, or otherwise unlawful or tortious material, or to store or transmit material in violation of third-party privacy rights.
- Use the Service to store or transmit malicious code (e.g., viruses, worms, Trojan horses).
- Interfere with or disrupt the integrity or performance of the Service or third-party data contained therein.
- Attempt to gain unauthorised access to the Service or its related systems or networks.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of the Service or any software, documentation, or data related to the Service.
- Modify, translate, or create derivative works based on the Service.
- Resell, lease, sublicense, or otherwise transfer your rights to access and use the Service.
5. Intellectual Property Rights
- Our Intellectual Property: The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by PIAGO, its licensors, or other providers of such material and are protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes during the term of your subscription, subject to these Terms
- Your Data: You (or your Organisation) retain all right, title, and interest in and to any data, information, or material that you upload, input, or submit to the Service in the course of using the Service (“Your Data”). You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display Your Data solely to the extent necessary to provide, maintain, and improve the Service and as otherwise permitted by these Terms and our Privacy Policy. You represent and warrant that you have all necessary rights to grant us this license for Your Data.
- Feedback: If you provide us with any suggestions, ideas, feedback, or recommendations regarding the Service (“Feedback”), we are free to use such Feedback for any purpose without any obligation or compensation to you.
7. Warranties and Disclaimers
- Service “As Is”: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
- Australian Consumer Law (ACL): The Australian Consumer Law provides consumers with certain consumer guarantees. These Terms do not exclude, restrict, or modify the application of any right, guarantee, or remedy that you may have under the ACL if that right, guarantee, or remedy cannot lawfully be excluded, restricted, or modified. If we fail to comply with a consumer guarantee, our liability is limited, to the extent permissible by law, to (at our option):
- in the case of services, the supplying of the services again or the payment of the cost of having the services supplied again; and
- in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired.
8. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PIAGO, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, ANY CONTENT OBTAINED FROM THE SERVICE, OR UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT OF FEES PAID BY YOU TO PIAGO FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100).
- The limitations in this section do not affect liability that cannot be excluded or limited under applicable law, such as liability for death or personal injury caused by our negligence or for fraudulent misrepresentation.
10. Service Levels and Support
While we strive to make the Service available 24/7, we do not guarantee any specific level of uptime unless explicitly stated in a separate Service Level Agreement (SLA) or your specific subscription plan. We will use commercially reasonable efforts to make the Service available and to provide support. Support options and availability will be detailed on our website or in your subscription plan. Scheduled maintenance will be notified in advance where possible.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Queensland, Australia to resolve any dispute arising out of these Terms or the Service.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service
